Legal fees & stamp duty, explained

Legal fees (Solicitors' Remuneration Order)

Legal fees for a Sale and Purchase Agreement, and separately for a Loan Agreement, follow a tiered percentage scale: 1.25% on the first RM500,000, 1.00% on the next RM500,000, 0.80% on the next RM2,000,000, 0.70% on the next RM2,000,000, 0.60% on the next RM2,500,000, and 0.50% on any amount above RM7,500,000, subject to a minimum fee of RM500. An 8% SST applies on top of the fee.

Stamp duty on the Memorandum of Transfer

Stamp duty on the transfer of the property is charged at 1% on the first RM100,000, 2% on the next RM400,000, 3% on the next RM500,000, and 4% on anything above RM1,000,000. A separate, flat 0.5% duty applies on the loan agreement amount where financing is used.

First-time buyer relief

Eligible first-time Malaysian homebuyers may qualify for stamp duty relief on both the transfer and loan agreement, subject to the property value threshold and conditions in force at the time of purchase. Toggle the option above to see an illustrative saving.

Disbursements

A typical transaction also carries disbursements for registration, searches and administrative charges. We include a general allowance in the estimate above; the exact figure depends on the property and state.
